Drug Crimes Chandler AZ

Drug laws in Arizona are both complex and harsh, with the penalty largely dependent upon the specific type of substance and the nature of its use. The simple possession of illegal substances will generally be treated less harshly than possession for sale or the transportation of drugs for sale. However, any type of involvement with an illegal substance, even a prescription medication, can result in a fine and a period of incarceration.

Drug Classifications

The state classifies drugs in different categories. Under the law, methamphetamine and LSD are among those classified as dangerous drugs, while such substances as cocaine, heroin and the painkiller oxycodone are defined as narcotics.

Marijuana

Marijuana is in a separate classification. It is against state law to have or use any of these substances in Maricopa County and its many cities, including Phoenix, Chandler, Gilbert, Glendale, Mesa, Scottsdale or Tempe, in the neighboring Pinal County or in other parts of Arizona. The possession of marijuana or narcotic drugs are both considered felonies. The penalty for marijuana possession will depend upon the amount the person is carrying, with the period of incarceration ranging from six months for those having less than 2 pounds to four years for those possessing more than 4 pounds. The crime of possession for sale can result in a sentence of no less than one year and a maximum of nearly four years in prison. The penalty for possession for the purpose of distribution can result in a prison sentence of up to 10 years.

Narcotic Drugs

Those found guilty of possessing narcotic drugs, including heroin or cocaine, or the illegal possession of a prescription medication, including oxycodone, can face a minimum prison sentence of one year and a maximum of three years. The possession for sale of these types of drugs can result in a prison sentence of up to 10 years, as can the transportation of drugs for sale, although the latter offense imposes a much larger fine. In addition to the drugs themselves, the possession of drug paraphernalia is felony offense in Arizona. Those convicted of such a crime can face a minimum of four months and a maximum of two years in prison, plus a minimum fine of $750.

Throughout Maricopa County, including the cities of Phoenix, Chandler, Gilbert, Glendale, Mesa, Scottsdale and Tempe, in the adjacent Pinal County and elsewhere in Arizona, those convicted of drug offenses or of the possession of drug paraphernalia can face serious consequences. The one bright spot is that the state allows for the conditional release or the participation in alternate sentencing in the case of first-time offenders.
